Privacy Policy

This version of our Privacy Policy will take effect on 19 November 2020

O.Vision is the trade name operated by O.Vision B.V. (the “O.Vision”), a legal entity duly incorporated and acting under the laws of the Netherlands. It provides (the “Services”) through an online software application and website operated by Company (the “App”).

This Privacy Policy is meant to help you understand how we use the information we collect to provide our Services on behalf of our clients and build trust in our system.

For information about how your specific data is being collected and used, please review the privacy policy of our client who is using our Services with you.

We may need to update this Privacy Policy from time to time, so we recommend you check back periodically If we make any substantial changes, we may notify you via email or by posting a notice on our website. Any information we collect is subject to the privacy policy in effect at the time it is collected. By continuing to access or use our Services after any changes come into effect, you are agreeing to the revised policy.

The User

Users are individuals whose identities we verify or otherwise check on behalf of our clients. We collect users’ information from clients or directly from the users themselves. This information might include an image of the User, photos or a video of the User, and the biometric facial identifiers in those images. In some circumstances, we may also collect device identifiers and IP addresses to help us understand whether a device has previously been used in relation to suspected fraudulent activity and whether O.Vision is permitted to provide Services in the country in which the user is located. To further com-bat fraud, we also collect identity information that has been leaked or otherwise made available on the internet.

The User

In some circumstances, we may also collect device identifiers and IP addresses to help us understand whether a device has previously been used in relation to suspected fraudulent activity and whether O.Vision is permitted to provide Identity Services in the country in which the user is located. To further combat fraud, we also collect identity information that has been leaked or otherwise made available on the internet.

The Information We Collect and How We Collect the Information from You

To provide our Services, we need to collect certain information about our clients' users including personal data and, particularly, biometric information. “Biometric information” means any information, regardless of how it is captured, converted, stored, or shared, based on an individual’s biometric identifier used to identify an individual.

We collect users’ information from clients or directly from the users themselves. This information might include an image of the User, photos or a video of the User, and the biometric facial identifiers in those images.

O.Vision collects the following personal information from you:

  • We collect biometric data through our facial recognition feature.
  • Name, address, telephone number, email address and payment information.
  • Communications with us e.g. comments, suggestions, a request for information about our products and services or any other correspondence or phone calls.
  • The way in which you use our services including in-App purchases.
  • Interactions with third-party service providers, marketing partners and affiliate interactions including.
  • We collect location based data (GPS coordinates) through our geolocation feature, if the Client has requested users to log in with their gps location.
  • We collect time entry and attendance data when you use the App.
  • Your Internet Protocol (IP) address (if using a browser), operating system, the browser type, the address of a referring site and any device identifier (if using a mobile device or tablet).

The lawful basis for collecting your data in this way is:

(a) You provide your consent at the point of registration for us to do so and by accepting our Terms & Conditions.

(b)Processing your data in the way explained above is necessary for us to provide O.Vision's services to users.

(c) Some of that data is processed for the purposes of our legitimate interests.

Under no circumstances do we collect any personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs.

We also keep logs of how our clients, users, and data providers interact with our Services. This might include timestamps of when the information was submitted to O.Vision, and information about the device used to submit that information.

Sometimes, we receive information we don’t need to provide our Services. For example, instead of a picture of their face, a user might upload a completely unrelated image. When this happens, we seek to delete this data.

Purposes of Information Collection

The purpose of collection of personal information is to provide our Services of biometric access control system.

How We Use Your Information

Start point: You fill out registration information such as name, zones of permission, contact information (email or phone), and upload a photo or take a new photo (If a new picture will be taken). A video stream is sent to the software, and a photo is saved to the desktop software.

Mobile Registration: Your phone number is recorded in our cloud software for a specific enterprise and physical devices attached. The facial features and your name are sent to the device. Facial features are stored locally on the device for access control in the location that the person receives an invite for. This image will be processed locally on the device for the purpose of facial recognition.

Facial biometric comparison: When providing our Services, we will frequently extract and compare numerical biometric data from facial images to understand whether two faces are likely to be a match.

To do all of this, we closely examine the information contained in the images, including the machine readable data and the image metadata (such as the name of the camera model used to take the image). When you are recognized the information is sent to the desktop software. If you are banned a signal is sent from desktop software to the device to not allow entry. Information of an entry is duplicated to the cloud server.

O.Vision uses personal information to improve the quality of the services that we offer. Ways in which we may do this include by:

  • Collecting, storing, and usage of biometric data solely for employee/visitor identification, fraud prevention, and pre-employment hiring purposes.
  • Cross-referencing your information with that received from our partners in order to provide a more enhanced and personalized App experience.
  • Using the information you provide in our communications with you. For instance, in responding to your comments or inquiries, to resolve disputes, to contact you regarding any other operational issues with the App or matters involving product or service transactions, to address problems on the App or our Services and to enforce our agreements with you.

Developing our Services

To further develop our Services, we train our computers to recognize specific patterns in information and make predictions about new sets of information based on those patterns. This is known as machine learning.

Sharing Your Information

We will not share personal information about you with any third party unless we have your permission or under the following circumstances:

  • Our group companies. We may share your personal information with our affiliates and group companies as reasonably necessary for the purposes set out in this Privacy Policy.
  • Service providers. We may share your personal information with companies with which we have contracted to provide services on our behalf, such as hosting websites, conducting surveys, processing transactions, analyzing our App and performing analyses to improve the quality of our business, the App, products and services. We require these service providers to protect the confidentiality of your personal information.
  • Distributors and other trusted business partners. We may sell, transfer or otherwise share some or all of our assets, which could include your personal information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of company liquidation.
  • Disclosure in connection with transactions. In connection with certain transactions, we may disclose some or all of your personal information to financial institutions, government entities and shipping companies or postal services involved in fulfillment of the transaction.
  • Disclosures in connection with acquisitions or divestitures. Circumstances may arise where for strategic or other business reasons O.Vision decides to sell, buy, divest, merge or otherwise reorganize businesses in some countries. We may disclose information we maintain about you to the extent reasonably necessary to proceed with the negotiation or completion of a merger, acquisition, divestiture or sale of all or a portion of O.Vision’s assets.
  • Disclosure for other reasons. We may disclose personal information if required or authorized to do so by law or in the good-faith belief that such action is necessary to comply with legal requirements or with legal process served on us, to protect and defend our rights or property or, in urgent circumstances, to protect the personal safety of any individual.

Any third party with whom our App shares user’s data will provide the same or equal protection of users’ data as stated in this Privacy Policy.

Security of Personal Data

We are committed to protecting the security of your personal information. We use a variety of security technologies and procedures to protect your personal information from unauthorized access, use or disclosure, including implementation of such security measures as may be required by applicable law. However, no information system can be 100% secure, so we cannot guarantee the absolute security of your personal information. Moreover, we are not responsible for the security of information you transmit to the sites over networks that we do not control, including the Internet and wireless networks.

The safety and security of your personal information also depends on you. Where we have given you (or where you have chosen) a User ID and password to access the App, you are responsible for keeping those log-on credentials confidential and not revealing them to others.

Retaining and Deleting Personal Data

Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes. We will retain your personal data as follows:

  • (a) Your name, email address, postal address and telephone number will be retained for a minimum period of 6 years.

In some cases it is not possible for us to specify in advance the periods for which your personal data will be retained. In such cases, we will determine the period of retention based on the following criteria:

  • (a) the period of retention of personal data will be determined by the possibility that you are still the User of the App.

If the User ceases to consent or affirmatively revokes consent for collection, use or disclosure of his or her user or device data, O.Vision (and any third party with whom O.Vision have contracted) shall promptly cease all such use.

Notwithstanding abovementioned provisions, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

Holding Information On Minors

The Services is not directed to minors and we do not knowingly collect personal information from them. Our Terms of Use state the Services can only be used by those who have reached the age of majority in the country (state or province) they reside.

If we learn that we have collected personal information of a minor then we will take steps to delete such information from our files as soon as possible.

Your Rights

You may have certain rights with respect to personal information about you that is collected through the App or when you contact us. The rights that apply to you will depend on the laws of your country of residence. We will facilitate your exercise of the rights that apply to you in accordance with applicable law. For more information about your rights, please contact us using the contact details at the end of this Privacy Policy.

  • Access: You may have the right to access, review and correct personal information collected through our App or when you contact us. In some cases, you can do this by going to the page on which you provided the information. You can help us to maintain the accuracy of your information by notifying us of any change to your mailing address, phone number or e-mail address.
  • Object: YOU MAY BE ENTITLED TO OBJECT TO CERTAIN TYPES OF PROCESSING ACTIVITIES INVOLVING YOUR PERSONAL INFORMATION, INCLUDING WHERE WE ARE RELYING ON A LEGITIMATE INTEREST TO PROCESS YOUR PERSONAL INFORMATION OR WHERE WE ARE PROCESSING YOUR PERSONAL INFORMATION FOR DIRECT MARKETING. IN SOME CASES, WE MAY DEMONSTRATE THAT WE HAVE COMPELLING LEGITIMATE GROUNDS TO CONTINUE TO PROCESS YOUR PERSONAL INFORMATION IN WHICH CASE WE ARE NOT OBLIGED TO COMPLY WITH YOUR REQUEST.
  • Erasure: You may be entitled to request the erasure of your personal information, for example, where the information is no longer necessary for the purposes for which it was collected.
  • Restriction: You may be entitled to request that we restrict our processing of your personal information, for example, where the accuracy of the information is contested by you.
  • Data portability: You may be entitled to receive and reuse your personal information for your own purposes. This is known as the right to data portability and, where applicable, requires us to move, copy or transfer your personal information from our systems to you or (where technically feasible) a third party chosen by you without affecting its usability.
  • Consent: If you have provided your consent to the processing of your personal information, you may have the right to withdraw your consent at any time by contacting us using the contact details at the end of this Privacy Policy or, in the case of email marketing, by using the “unsubscribe” link in any of our marketing emails. This won’t affect the lawfulness of any processing up to that point.

We will respond to any requests from you to exercise your rights within the timeframes required by law. We may charge a fee to facilitate your request where permitted by law. To exercise any of your rights, please contact us using the contact details set out at the end of this Privacy Policy. We may take steps to verify your identity before taking action on a request. If you believe our processing of your personal information does not comply with data protection law, you can make a complaint to the supervisory authority in charge of overseeing compliance with data protection law in your jurisdiction. We would however appreciate the chance to address your concerns, so please feel free to contact us regarding any complaint you may have.

We automatically collect certain information using "cookies”. These are small files that your browser places on your computer. Most Internet browsers automatically accept cookies. If you do not allow cookies, however, some parts of the Services may be restricted.

We use cookies to:

  • Monitor and analyse your use of the App and our Services.
  • For technical administration of the App.
  • To increase the functionality and user-friendliness of our App and our Services.
  • To better tailor the App to our visitors’ needs.

We may use both session cookies and persistent cookies to:

  • Better understand how you interact with our App.
  • Monitor aggregate usage by our users and web traffic routing on our App.
  • Improve our App.

This privacy policy is only applicable to our Services and App.
